521.13  MAINTENANCE OF A NUISANCE, STORING OF REFUSE PROHIBITED.
   (a)   No person, firm or corporation, having ownership or possession of premises located within the Village, shall create or maintain a nuisance on such premises which endangers the life, healths, safety or general welfare of the residents of the Village of Bradford.
   (b)   It shall be a violation of this section to store or to allow to remain on the premises within the Village any used building material, motor vehicle parts, scrap metal, refuse, rubbish or garbage, building debris, or such other materials or substances which create a public nuisance or endanger the health, safety or general welfare of the residents of the Village.
   (c)   The Chief of Police or other designated official may cause a notice of a violation of this section, and the action to be taken to remove the violation, to be served by personal service or by certified mail.  If the condition causing the violation is not removed or resolved within five days, a citation to appear in Mayor’s Court shall be issued to the owner or to the person in possession of such premises.
   (d)   A person, firm or corporation found in violation of this chapter is guilty of a minor misdemeanor on the first offense.  On the second offense, within one year after the first offense, violation of this section shall be a misdemeanor of the fourth degree.  On each subsequent offense within one year of the original offense, a violation of this section shall be a misdemeanor of the third degree, with punishment as provided for in the Ohio Revised Code.  Each twenty-four hour period after the expiration of the required notice may be considered a separate offense for the purpose of this penalty section.
