1167.21  PUBLIC SITES, OPEN SPACES.
   Where a proposed park, playground, school or other public use is shown upon the Master Plan or where in the interest of the public safety, health and welfare, the Planning Board determines it to be feasible and necessary to provide for open spaces for recreation, light and air and for the avoidance of congestion of population, such site or space not exceeding 5% of the area of the subdivision, the owner, subdivider or agent shall set aside for sale to the Village at a price mutually agreeable to the Village and subdivider, taking into consideration the raw land cost to the subdivider, for a period agreeable to the Village and subdivider not to exceed two (2) years.  Where the subdivision tract contains less than 40 acres, such reservation for open space shall be combined, wherever practicable, with similar reservations in adjoining tracts or the Planning Board may require the subdivider to grant the Village an opportunity to acquire additional area in excess of 5%.
