1137.21  HOME OCCUPATION.
   (a)   Home Occupation Permit Required.
      (1)   All home occupations within the corporate limits of the Village will require  a valid permit.
      (2)   All permits must be renewed annually; subject to the approval of the Zoning Board.
 
   (b)   Home Occupation Permit Generally.
      (1)   Home occupation permits approved by the Planning Board of the Village shall expire one year after the approval date.
      (2)   Home occupation permits to be renewed must be submitted to the Planning Board for approval or disapproval, 30 days prior to the expiration date.
      (3)   Application for a home occupation permit (or renewal) must be in written form.
 
   (c)   Application.
      (1)   Application forms for home occupation permits are on file at the office of the Clerk for the Village.
      (2)   Applicant shall prepare home occupation permit forms in triplicate.
      (3)   Applicant shall answer all information on application form.
      (4)   Application shall be accompanied by a detailed drawing showing the proposed floor space, to be used for home occupation.
      (5)   Applicant shall sign application.
      (6)   Drawing need not be to scale but shall be legible and the minimum size shall be 8½ inches by 11 inches.
      (7)   Drawing shall include:
         A.   Street name and location.
         B.   Zone.
         C.   All property lines and measurements.
         D.   Location of existing structures on lots, if any, including dimensions.
         E.   Location of existing structures on all adjoining lots.
         F.   The owner of record of property within 100 feet of the premises in question.
         G.   Any other information which might help the Planning Board in reviewing the application.
 
   (d)   Fees.
      (1)   Application and renewal fees will be $10.00 per year.
      (2)   Home occupation permit fees shall be paid at the time the permit is received at the Clerk’s Office, payable to the Village of Bradford. (Non-refundable).
 
   (e)   Clerk Procedure.
      (1)   Application along with drawings and plat plan shall be filed with the Clerk of the Village.
      (2)   Clerk shall assign a number as outlined in subsection (f) hereof, to the application and log the number, address, lot number and applicant’s name in Planning Board control book.
      (3)   Clerk shall forward application along with the drawings, to the Planning Board to be acted upon.
      (4)   After Planning Board has taken action on the home occupation permit, the Clerk shall collect the permit fees as listed in subsection (d) hereof.  One copy of the application shall be returned to the applicant.  Original copy of the permit and all drawings shall be kept on file in the Clerk’s office.
 
   (f)   Numbering of Home Occupation Permits.
      (1)   Numbers shall be assigned by the Clerk of the Village.
      (2)   Numbers shall start at (1) one, preceded by the letters HO, Home Occupation Permit, and run consecutively for a period of one year, January 1st through December 31st.
      (3)   At the beginning of each new year the home occupation numbers shall again start at one preceded by the letters HO.
      (4)   When the Planning Board acts upon the application, the Planning Board Secretary shall add the number one (1) through twelve (12), and the last two digits of the year, which will indicate the month and year the application was acted upon.  (Example HO-1-7-83).
      (5)   The Planning Board Secretary shall enter the above information to the application and into the Planning Board Control Book along with the action taken on the application, and the date the permit expires.
 
   (g)   Planning Board Procedure.
      (1)   All home occupation permit applications shall be acted upon by the Planning Board at the first meeting following the applicant’s application.
      (2)   All applications shall be approved, disapproved, or held until the following meeting to allow the Planning Board to investigate any unusual circumstances in regard to the application.
      (3)   All applications shall be approved or disapproved by not less than a majority vote of the full membership of the Planning Board.
      (4)   The Secretary of the Planning Board shall place in the minutes of the meeting the record of the voting.
      (5)   The Secretary shall place on the application and enter in the Control Book the information as listed in subsection (f)(5) hereof.
      (6)   All applications approved shall be signed by the Chairman of the Planning Board.
      (7)   The Secretary of the Planning Board shall inform the applicant by letter the results of the Planning Board’s action.
      (8)   The Planning Board will be required to hold at least one public hearing on the proposed home occupation permit(s).
      (9)   Public notice of the home occupation hearing must be published no less than ten days before the date set for the hearing.
