557.07  REMOVAL OF TREES, SHRUBBERY, OR BUSHES WHICH CREATE OBSTRUCTIONS.
   (a)    Responsibility. It shall be the responsibility of any property owner whose real property borders on any street or sidewalk, and upon which property there may be trees, shrubbery, hedges or other plants to prune or trim such trees, shrubbery, hedges or other plants in such a manner that they will not obstruct or shade the street lights, obstruct the passage of pedestrians on sidewalks, obstruct the vision of traffic signs or obstruct the view of any street intersection. Said persons shall remove all dead, diseased or dangerous trees, or broken or decayed limbs which constitute a hazard to the safety of the public. The minimum clearance of any overhanging portion thereof shall be ten (10) feet over sidewalks and drive aprons, and fourteen (14) feet over all streets except truck thoroughfares which shall have a clearance of sixteen (16) feet.
   (b)    Notice to Prune. Should any person or persons owning or having control of such real property bordering on any street or sidewalk fail to prune trees, shrubbery, hedges, or other plants, as provided for in this section, the Village Administrator shall serve notice on such person or persons to trim the tree limbs or branches, shrubbery, hedges or plants so they no longer violate the provisions of this section. Such owner or person having control of the property shall have seven (7) days from receiving such written notice (or seven (7) days from notice being posted if the person cannot be located), to comply with the notice. All trimmings shall be disposed of properly.
   (c)    Village to Remove Obstruction. If the tree limbs, branches, shrubbery, hedges or other plants are not trimmed and disposed of in accordance with this section within the seven (7) day period, the Village Administrator or designated representative are hereby authorized and empowered to go upon the property and cause the tree limbs, branches, shrubbery, hedges, or other plants to be trimmed and disposed of properly.
   (d)    Assessment of Cost. The cost thereof, at a rate of one hundred fifty dollars ($150.00) per man hour, port-to-port, together with an administrative fee of fifty dollars ($50.00) and the charge for recording the lien, shall be assessed against the real property and a statement of costs and fees shall be sent to the owner or to the person or entity having control of the property. The statement shall be posted in a conspicuous place on the property. The total assessment shall bear interest at six percent (6%) per year from the date of assessment until paid.
