(a) Definition of Snow Emergency. During any period of time prior to, during and after snow falls in the Village of Bradford to a depth of three inches or more, a snow emergency may be declared to exist, due to the fact that such a heavy snow fall constitutes a serious public hazard. During such times, the parking of vehicles upon public streets within the Village may hinder, delay or obstruct the safe flow of traffic and emergency vehicles and the cleaning, clearing and making safe of all public streets of this Village.
(b) Declaration of a Snow Emergency. The Mayor, the Village Administrator, or in their absence, the President of Council, when it is determined that the definition of a snow emergency exists, may declare such a snow emergency. Then, upon the declaration of a Snow Emergency, said official shall take such steps as are reasonable under the circumstances to notify residents of the Village of the existence of a snow removal emergency by notifying the local media or such other means as may be effective to communicate to residents. The notice shall include the decision that all motor vehicles are to be removed from the streets of the Village and the time period during which this removal must take place. However, owners and operators of motor vehicles shall have the full responsibility to be aware of existing weather conditions and to comply with emergency parking regulations when such emergency is in effect.
(c) Removal of Vehicles from the Public Rights of Way. When the Mayor, the Village Administrator, or in their absence, the President of Council, has declared that a Snow Emergency exists, it is important that the Village Street Department clear all public streets of accumulation of snow to allow for necessary travel and access by emergency vehicles. To allow snow removal operations to proceed as efficiently and safely as possible, it is necessary to remove all vehicles parked on the Village streets or roads so that these streets may be cleared from curb to curb. Therefore, when a Snow Emergency has been declared, it shall be unlawful for the owner or operator of any motor vehicle to park or permit to remain parked any vehicle on any street or road within this Village. However, vehicles may be parked for a period of not longer than five minutes for the loading or unloading of passengers or thirty minutes for loading or unloading of property, provided that no other ordinance restricting parking as to place or time is violated thereby.
(d) In the event that vehicles remain on the streets after the declaration of a Snow Emergency, creating a hazard and an obstacle for snow removal operations, the Miami County Sheriff Deputy may arrange for the removal and storage of such motor vehicles, at the expense of the owner.
(e) Nothing in this section shall prevent the parking of motor vehicles on the streets of this Village after streets have been cleared of snow from curb to curb.
(f) The Village Administrator is directed to cause signs to be erected at appropriate locations advising of the provisions of this section.
(g) Whoever violates the provisions of this section shall, in addition to paying the costs for removal and storage of their motor vehicle, be guilty of a minor misdemeanor for the first offense and upon a second or subsequent offense within one year of the first, a misdemeanor of the fourth degree.
