143.05  GENERAL PARK RULES.
   •    The community park shall be open to the public from dawn to dusk, at which time the park is closed.  The time of dawn and dusk shall be determined by the regional weather authority.  The Village may grant an exception or special use permit for use of the park after dusk as determined by Council or the Village Administrator.

   •    Firearms: No concealed firearms may be brought onto public property in the Village, including Village parks, except as may be provided in this section or as otherwise permitted under the Ohio Revised Code.  In order to lawfully carry a concealed handgun onto any public property in the Village, including parks, a person must have been issued, and possess on their person, a valid concealed handgun license under Ohio R.C. 2923.125 or 2923.1213 and valid identification (See Ohio R.C. 2923.126).  (Ord. 14-07.  Passed 7-10-14.)
   •    No littering.
   •    No glass containers.
   •    No alcoholic beverages.
   •    No amplified music in the park.
   •    No motorized vehicles to be operated in the park, except handicapped mobility products.
   •    No bicycle riding in the park except on designated bicycle paths.
   •    Bringing pets to the park is discouraged; however, if a pet is in the park, it must be restrained on a leash no longer than 6 feet. The person in control of the animal is responsible for immediate cleanup of all feces.
   •    No camping.
   •    No ground fires permitted.
(No exceptions without a signed facilities agreement.)

   •    Do not remove tables from shelter.
   •    Do not remove coals from barbecue.
   •    No pets allowed under shelter.
   •    No sitting on top of picnic tables.
      Trails
   •    Speed limit - 10 MPH.
   •    Stay to right.
   •    Maintain 2-way traffic.
      Basketball Court
   •    No hanging from nets or rims.
   •    No pets on court.
   •    Share court time with others.
      Tennis Court
   •    No sitting on net.
   •    No skates, skateboards, etc. on court.
   •    Tennis court is for tennis only.
   •    Maximum allowed playing time - 2 consecutive hours.
      Toys
   •    Age 12 and under only on playground equipment in enclosed mulched area.
   •    No food and beverages in mulched area.
   •    No removal of mulch.
   •    No sharp objects on equipment.
      Volleyball Court
   •    No hanging on net.
   •    Volleyball court is for volleyball only.
   •    Maximum allowed playing time - 2 consecutive hours.
   •    No food and beverages in sand area.
   •    No digging or removal of sand.
Fees and/or deposits:
The park facilities may be reserved for exclusive use. A facilities agreement must be signed and the dates reserved with the Village Administrator or other duly authorized representative of the Village. Fees for such use will be charged as designated below for the continued maintenance and improvement of the community park. Deposits will also be charged and are refundable with approved cleanup and inspection with no damage. The person who enters into the facility agreement shall be responsible for any damages, cleanup, and other designated requirements.

   Recreational purposes only - absolutely no fund raising activities:
   Deposit -    $30.00 per day per section
   Fee -       Resident - $5.00 per section plus deposit
         Non-resident - $10.00 per section plus deposit
   Fund raising activities:
   Deposit -    $30.00 per day per section
   Fee - Resident - $10.00 per hour per section plus deposit (Max. $90.00 per day)
   Non-resident - $20.00 per hour per section plus deposit (Max. $180.00 per day)
Reservation of the entire park will be fee plus deposit. No person or organization may occupy the park for more than 7 consecutive days. Fees may be charged for additional days of use following the event if equipment, dumpsters, portable restrooms facilities, etc. are not removed. The Village may cause such items removed at the applicant's expense due to failure to clear the area.
The contact person for administration of park rules and regulations as well as inspections following use shall be the Village Administrator or his duly authorized representative. Unless an emergency situation occurs, contact should occur during regular business hours.
Liability responsibilities:
Certificates of insurance (minimum of $1,000,000 liability) may be required for facility reservations, depending on the scope of the event. The certificates can be obtained through the event holder's insurance carrier. The Village must have a signed original copy of the insurance certificate before the event can be scheduled on the calendar. Your insurance carrier may charge an additional fee for the "additional insured endorsement".
Each general liability policy shall be endorsed with the following specific language:
"The Village of Bradford, its officers, agents, and employees, is named as additional insured for all liability arising out of the operations by or on behalf of the named insured in the performance of this agreement."
"The insurance provided is primary coverage of Village of Bradford with respect to any insurance or self insurance programs maintained by the Village, and no insurance held or owned by the Village shall be called upon to contribute to a loss."
The location and date of event must be included on certificate.
Additional cleanup responsibilities:
When using the park, the Village asks that all excess trash is picked up and placed in dumpsters behind the City Building.
Dumpsters may be required for refuse generated from a large event. The applicant is responsible for making these arrangements by contacting a local disposal service.
Portable restroom facilities may be required for groups in excess of 100 at a rate of 1 per 100 people. The applicant is responsible for arranging services and the Village Administrator shall designate the location of the facilities.
Miscellaneous considerations:
For large events with an expected attendance of over 100 people and/or lasting more than 1 day, a detailed event plan explaining the provisions planned for use of facilities must be submitted to the Village Administrator at least 60 days prior to the event. Upon approval of the event plan, receipt of required payment, filing of certificate of insurance and copies of any necessary permits, the Village Administrator will enter into a facilities agreement with the event representative.
In extenuating circumstances, the Administrator may ask that a representative of the organization approach the Village Council for approval of a planned event before entering into a facilities agreement with the organization.
Services required may include water, sewer, and electric. These services can be obtained from the Village at a reasonable cost. The Administrator will advise the representative of the current rate schedule for such services in accordance with the Water and Sewer Use Ordinance.
Before any sale of any food can occur on Village properties, a county food permit must be obtained in advance of the event.
Parking must be planned for large events. The Village is aware that casual use will take up some available parking sites; however, if the event is expected to approach levels that will exceed parking capability, arrangements should be made with the Village Administrator or other duly authorized representative of the Village of Bradford.
Although camping within the park is not encouraged, special consideration may be entertained for large and/or special events. In such cases, the organization will be assigned a limited number of camping spaces in designated areas at a cost of $10.00 per unit per day. Each unit must display a permit issued by the Village.
Large events may require the organization to obtain additional security services. This may be coordinated with the Miami County Sheriff's office, the Village Administrator, and the organization's agent.
The Village Administrator shall keep a calendar of all park reservations and announce them prior to the event at a regularly scheduled Village Council meeting during the Administrator’s scheduled report to Council. He will also provide a list to the Miami County Sheriff's office to advise deputies of reservations.
