951.04  SERVICE CHARGES.
   The charges for normal refuse collection shall be twenty-two dollars and fifty cents ($22.50) per customer per month.  It is the intention of this section that each family or person occupying a separate place of abode, and each business or firm, shall make separate provisions for the collection and removal of garbage and refuse.

   (a)   Additional charges.  Additional fees may be charged for major appliances, tree trunks, stumps and similar heavy and bulky refuse at the discretion of the Village Administrator, and subject to the approval of Council.
   (b)   Billing.  Bills for refuse collection shall be rendered monthly and shall be payable in advance to the Clerk-Treasurer, or the designated agent.  Net payments are due and payable on the tenth day of each month.  If net payment date falls on a Sunday or a holiday, it shall be due on the next open business hours.  If not paid by the net payment date, a penalty of ten percent (10%) will be added on all bills.  If not paid in full within twenty days of net payment date, the premise shall be deemed as being in arrears. All unpaid accounts for refuse service, shall be a lien against the property served.
   (c)   Collection Conditions.  The collection of all refuse is conditioned under the observance of all provisions of this chapter.  Collection is subject to weather conditions and other conditions beyond the control of the Village.  It shall be the duty of the Village Administrator to collect or provide for the collection of all garbage and other refuse from all householder’s premises within the Village at least  once each week.  It shall be the duty of the Village Administrator to collect or provide for the collection of all garbage and other refuse from the premises of all commercial establishments within the Village as provided by each individual contract.
   (d)   Future Annual Collection Charges.  Rates as established by this chapter shall be subject to revision by Council at any time.
   (e)   Uncollected Garbage.  No garbage or refuse shall be collected from any premises where the owner or lessee is in arrears.  Fermenting, purifying or odoriferous garbage in containers uncollected or dumped in the open, due to the failure to pay garbage fees, shall be declared a nuisance.
