(A) An appeal may be taken from a decision of the Planning Director with respect to the interpretation of or decision made under this chapter, or from the decisions of the Historic Preservation Commission under Chapter 158. Such appeal may be taken to the Board by any person aggrieved, or his or her agent, or by any officer of the city affected by such decision of the Planning Director, the City Attorney, or the Historic Preservation Commission. Appeals to the Board shall be filed within 20 days after the decision of the Planning Director by filing a written notice of appeal to the Board. An appeal stays all proceedings to furtherance of the action appealed from, unless the Planning Director from whom the appeal is taken certifies to the Board after the notice of appeal is filed with him or her, that by reason of facts stated in the application, a stay would in his or her opinion, cause imminent peril to life and property. In such case, proceedings shall not be stayed other than by a restraining order which may be granted by the Board or by a court of record on application, on notice to the Planning Director from whom the appeal is taken on due cause shown.
(B) An appeal shall stay all proceedings in furtherance of the action appealed from unless the Planning Director shall certify to the Zoning Board of Appeals, after the notice of appeal shall have been filed with it, that by reason of facts stated in the certificate a stay would, in their opinion, cause imminent peril to life or property; in which case proceedings shall not be stayed otherwise than by a restraining order from a court of general jurisdiction.
(C) The Board may, in conformity with the provisions of this chapter, reverse or affirm, wholly or in part, or may modify the order, requirement, decision, or determination appealed from and shall make such order, requirement, decision, or determination as in its opinion ought to be made in the premises; and to that end, shall have all powers of the Planning Director from when the appeal is taken.
