§ 73.06 PROHIBITION AGAINST OPEN CONTAINERS AND CONSUMPTION IN MOTOR VEHICLES.

(A) No person shall be in possession of an open container of beer or intoxicating liquor while in a motor vehicle. A person shall be IN POSSESSION within the meaning of this section if an open container of beer or intoxicating liquor is located anywhere within the passenger compartment of the vehicle.

(B) No person shall consume beer or intoxicating liquor while in a motor vehicle.

(C) Whoever violates the provisions of division (A) herein shall be guilty of a minor misdemeanor. Whoever violates the provisions of division (B) herein shall be guilty of a misdemeanor of the fourth degree.
