§ 31.009 FIRE EQUIPMENT REPLACEMENT FUND.
   (A)   A separate fund is hereby created to be designated as the Fire Equipment Replacement Fund.
   (B)   The town and the township of the county may make deposits to such fund as such governmental entities may hereafter agree.
   (C)   Such Fund shall be maintained as a fund separate from the General Fund or other accounts of the town.
   (D)   Such Fund shall be continuing in nature and shall not be drawn upon except for the specific purpose that such fund is created for pursuant to this section.
   (E)   The purpose of this fund shall be specifically to provide equipment for fire protection purposes for the residents of the town and the township of the county.
   (F)   The town and the township of the county, by their proper elected officials, shall hereafter enter into a written agreement which will define how the Clerk-Treasurer of said town may draft against such fund for the stated purpose of the same.
