§ 152.081 BUILDING PERMIT APPLICATION.
   (A)   All proposed buildings, structures, facilities and uses located within the corporate boundaries of the town, excluding agricultural buildings to the extent exempted by the laws of the state, and requiring the approval and issuance of a building permit, as required by the Building Codes of the town, shall present a building permit application for review by the town’s Building Inspector.
   (B)   As provided by § 152.009 of this chapter, the town may enforce this chapter by withholding building permits.
   (C)   It is unlawful to erect, construct, reconstruct, alter or change the use of any building or other structure within the town without approval of a building permit.
   (D)   The town may not issue a building permit unless the plans of and for the proposed erection, construction, reconstruction, alteration, or use fully conform to all regulations then in effect, including the requirements of this chapter, and all other land use ordinances.
   (E)   From the effective date of this chapter, no license or permit, including the issuance of a building permit for the construction, alteration or modification of any building or structure, shall be issued by the town unless such permit or license complies with the requirements and provisions of this chapter, including a determination that the lot or parcel proposed for the license or permit is a legal lot created pursuant to the provisions of this chapter, or subsequent subdivision ordinances, or is a legal lot of record. Any license or permit issued in conflict with the provisions and requirements of this chapter shall be void.
