§ 94.01 PROHIBITING THE USE OF MOTOR VEHICLES ON CITY SIDEWALKS.
   (A)   For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
      VEHICLE. Includes:
         (a)   “Bus” as defined in M.C.A. § 61-1-101(3);
         (b)   “Custom vehicle” as defined in M.C.A. § 61-1-101(10);
         (c)   “Implement of husbandry” as defined in M.C.A. § 61-1-101(22);
         (d)   “Kit vehicle” as defined in M.C.A. § 61-1-101(23);
         (e)   “Motorcycle” as defined in M.C.A. § 61-1-101(31);
         (f)   “Motor-driven cycle” as defined in M.C.A. § 61-1-101(32);
         (g)   “Motor home” as defined in M.C.A. § 61-1-101(33);
         (h)   “Motorized nonstandard vehicle” as defined in M.C.A. § 61-1-101(34);
         (i)   “Motor vehicle” as defined in M.C.A. § 61-1-101(35);
         (j)   “Off-highway vehicle” as defined in M.C.A. § 61-1-101(39);
         (k)   “Quadricycle” as defined in M.C.A. § 61-1-101(46);
         (l)   Golf carts;
         (m)   “Recreational vehicle” as defined in M.C.A. § 61-1-101(49);
         (n)   “Snowmobile” as defined in M.C.A. § 61-1-101(58);
         (o)   “Special mobile equipment as defined in M.C.A. § 61-1-101(59);
         (p)   “Specially constructed vehicle” as defined in M.C.A. § 61-1-101(60);
         (q)   “Trailer” as defined in M.C.A. § 61-1-101(68);
         (r)   “Travel trailer” as defined in M.C.A. § 61-1-101(70);
         (s)   “Truck” or “motortruck” as defined in M.C.A. § 61-1-101(71);
         (t)   “Truck tractor” as defined in M.C.A. § 61-1-101(72);
         (u)   “Van” as defined in M.C.A. § 61-1-101(75); and
         (v)   “Vehicle” as defined in M.C.A. § 61-1-101(76).
   (B)   A person shall not drive, stand, stop or park, a vehicle as defined above on the sidewalks of the city.
   (C)   The foregoing provision does not apply to operation of:
      (1)   An authorized emergency service vehicle or police vehicle, as defined in M.C.A. § 61-8-102(2):
         (a)   Equipped with audible and visual signals as required under M.C.A. §§ 61-9-401 and 61-9-402; and
         (b)   Entitled to the exemptions granted under M.C.A. § 61-8-107.
      (2)   A vehicle operated for military purposes by active duty military personnel, a member of the military reserves, a member of the National Guard on active duty, including personnel on full-time National Guard duty, personnel in part-time National Guard training, and National Guard military technicians, or active duty United States Coast Guard personnel;
      (3)   An electric personal assistive mobility device as defined in M.C.A. § 61-1-101(17);
      (4)   A manually- or mechanically-propelled wheelchair or other low-powered, mechanically propelled vehicle that is designed specifically for use by a physically disabled person and that is used as a means of mobility for that person; and
      (5)   A vehicle owned or operated by the city or the state or their contractors for the purpose of maintaining or repairing city sidewalks, streets or other infrastructures.
   (D)   Notwithstanding the foregoing provision, the Mayor or City Council may grant a temporary permit for a vehicle to drive, stand, stop or park, a vehicle as defined above on the sidewalks of the city to service adjacent buildings or for other specified purposes.
