§ 32.06 TREE ADVISORY BOARD.
   (A)   Title and purpose.
      (1)   This section shall be known as the “Tree Ordinance.”
      (2)   The purpose of this section is to establish a Tree Board. This section does not address tree planting on private land.
   (B)   Definitions. For purposes of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning. When not inconsistent with the content, words used in the present tense include future, words in plural include the singular and words in the singular include plural. The word “shall” is mandatory and not merely directory.
      CITY. The City of Boulder, Jefferson County, Montana.
      PERSON. Any person, firm, partnership, association, corporation, company of any kind.
   (C)   Establishment of a Tree Board.
      (1)   Creation of Tree Board. 
         (a)   There shall be created a Board to be known as “Tree Board” composed of five citizens of the city. All five members shall be appointed by the City Council. The Board is an advisory board which will provide advice and information regarding trees to the Mayor, City Council and city staff.
         (b)   All members of the Tree Board shall serve without pay. Committee members shall be appointed as follows: Three for three years and two for two years and serve until their successors are duly appointed and approved by the City Council. The Tree Board shall select a Chairperson and Secretary from among the members of the Board.
      (2)   Duties of the Tree Board. 
         (a)   The duties of the Tree Board shall be to study the problems, determine the needs and provide recommendations to the city, and establishing a tree planting and maintenance program.
         (b)   Other duties shall be to assist the properly constituted officials of the city, as well as the Council and citizens of the city in the dissemination of news and information regarding the selection, planting, maintenance and removal of trees within the corporate limits, and to make such recommendations from time to time to the City Council, as to desirable legislation concerning the tree program and activities for the city. The Tree Board shall provide regular and special meetings at which the subject of trees insofar as it relates to the city may be discussed by the members of the Board, officers and personnel of the city, and all others interested in the tree program.
      (3)   Adoption of rules. Within a reasonable time after the appointment of said Board and the approval of the members thereof, upon the call of the Chairperson, said Tree Board shall meet and organize such other officers and committees as may be appropriate. The said Tree Board shall then provide for the adoption of rules and procedures and for the holding of regular and special meetings as said Tree Board shall deem advisable and necessary in order to perform the duties set forth.
