§ 32.02 BOARD OF HEALTH.
   (A)   There be and is hereby created a Board of Health in and for the city. Such Board of Health shall consist of the Mayor, the Sanitary Committee of the Council and a regularly licensed and practicing physician residing within the city, who shall be appointed by the Mayor, with the consent of the Council, and who shall be designated as Secretary of the Board of Health and Health Officer; who shall serve for one year and without compensation.
   (B)   The said Board of Health shall exercise a general supervision over the health and general cleanliness of the city, and is hereby given full power to take all necessary and proper steps to ensure the good health and cleanliness of the city. It shall have full power to prevent the introduction of all infectious and contagious diseases into the city; to remove to a place provided for that purpose all persons suffering from infectious or contagious diseases when, in its judgment, such removal is necessary.
   (C)   The Board of Health is thereby given power and authority to adopt such rules and regulations, and to do all acts which may be necessary for the promotion of health, and to prevent the spread of infectious or contagious diseases within the city.
   (D)   The Health Officer shall visit and examine, or cause to be visited and examined, every side person who shall be reported as sick with any contagious or infectious disease, and such person, if necessary, shall be removed to the pest house, or other place provided for persons sick with contagious or infectious diseases; and when so removed, provide him or her with suitable nurses, medical attendance and medicine. If a person so dealt with is unable to pay the expense thereof, it shall be borne by the city or employee of any restaurant, butcher shop, hotel or boarding home shall be required to make provisions for and to remove all garbage swill, slope or other refuse matter daily from their places and shall not be permitted to place, throw or deposit the same in any cesspool, privy or vault in the city, unless such cess pool or vault has been provided for the public use and place of deposit thereof, by the City Council.
   (E)   It shall require a two-thirds vote of the Council to change any order or act of the Board of Health.
