§ 95.01 SKATEBOARD PARK.
   (A)   This section shall be known and may be cited as the “Skateboard Park Ordinance of the City of Boulder, Montana.”
   (B)   It shall be unlawful for any person to use the city skateboard park without complying with the conditions hereinafter set forth.
   (C)   All persons using the skateboard park must comply with the following restrictions and requirements.
      (1)   The skateboard park is open from dawn to dusk.
      (2)   All persons within the skateboard park area must be alert and exercise common sense and be considerate of other users. Know your abilities and skate within them.
      (3)   Proper use of protective gear (helmets, wrist guards, elbow and knee pads) is strongly recommended.
      (4)   Only skateboards and in-line skates are allowed. No bicycles, scooters or motor vehicles are allowed.
      (5)   No food or drinks are allowed on or near the skateboard park.
      (6)   No alcohol, tobacco or unlawful drugs are allowed on or near the skateboard park.
      (7)   The skateboard park surface is dangerous when wet. Do not use the park in inclement weather.
      (8)   Spectators should watch from outside the facility to keep themselves and the skaters safe.
      (9)   Keep the skateboard park clean. Do not litter.
      (10)   Be considerate of the surrounding neighbors by skating in the designated area. Keep noise down.
      (11)   Keep pets out of the skateboard park.
      (12)   No additions or alterations shall be made to the skateboard park such as benches, tables, wood materials or other objects, to be used as ramps or jumps, or for other purposes.
      (13)   The skateboard park is not supervised.
   (D)   In their interpretation and application, the provisions of this section shall be held to be requirements adopted for the promotion of the health, safety and welfare of the general public. Whenever the requirements of this section are at variance with the requirements of any other lawfully adopted rules, regulations or ordinances, the more restrictive or that imposing the higher standards shall govern.
