§ 52.08 SEWER SURCHARGES AND PENALTIES.
   (A)   Any capital cost expenditures for improvement of, alteration to, extension of or additions to a public sewer or the municipal waste works, shall be borne by the residential users or industrial dischargers directly or indirectly benefited by such improvement, alteration, extension or addition, by assessment against those whose property abuts upon the improvement, alteration, extension or addition, or by all residential users or industrial dischargers of the public sewer or municipal waste works based on flow volume usage by each such user, all as provided by the Ohio Revised Code.
   (B)   (1)   STANDARD STRENGTH SEWAGE shall be defined as that sanitary sewage or industrial wastes containing not more than 300 mg/l of B.O.D. and 300 mg/l of S.S.
      (2)   In the event that any sanitary sewage or industrial wastes is found to be in excess of standard strength sewage, the residential user or industrial discharger shall pay a penalty of $0.40 per pound of B.O.D. and $0.40 per pound of S.S., both calculated in the following formulas:

      (3)   The Village Administrator shall assess residential users or industrial dischargers for any additional fees, costs and expenses as may be necessary due to enforcement actions and legal fees, costs and damage from slug loads, accidental spills, bypasses, any special non-routing compliance monitoring surveillance and analysis and/or other just cause applicable to a residential user or industrial discharger.
   (C)   The village may, in its sole discretion, add to all sewage flow related charges, a 50% surcharge for all residential users or industrial dischargers outside the corporate limits of the village.
   (D)   Any industrial dischargers discharging industrial wastes estimated in excess of 5,000 gallons per day (average), shall be required to provide an approved flow meter to record discharges of such industrial wastes.
   (E)   The calculation of the discharge of industrial wastes and sanitary sewage, the number of residential users and industrial dischargers, the inflation rate, and other pertinent data shall be used to recompute sewage charges and surcharges, and shall be based upon records from the preceding 12-month period, adjusted for any known discrepancies.
   (F)   The sewage charges and surcharges established herein, shall be reviewed and recomputed, if necessary, not less than once every three years.
