§ 150.01 OHIO BUILDING CODE.
   (A)   O.A.C. 4101:1, the Ohio Building Code, and O.A.C. 4101:2, the Ohio Mechanical Code, as promulgated by the Ohio Board of Building Standards, shall apply and be enforced within the village, for all commercial buildings that are erected, constructed, repaired or altered within the village; except that O.A.C. 4101:3, the Ohio Plumbing Code, shall be enforced by the local board of health, the County Health District.
   (B)   This section shall be in full force and effect from and after the earliest period permitted by law following promulgation of the Ohio Building Code and the Ohio Mechanical Code by the Ohio Board of Building Standards through the certification process, adoption, and effective date of certification issued by the Ohio Board of Building Standards.
   (C)   The Village Administrator is hereby authorized and directed to sign and submit the necessary applications to the Ohio Board of Building Standards requesting said Board to certify the village for enforcement of the Ohio Building Code with the condition that the County Building Department exercises the enforcement authority as necessary in accordance with the Ohio Building Code within the limits of said village, and enters into an agreement with the County Building Department for such purpose.
   (D)   The village through its Village Administrator and its Village Fiscal Officer is hereby authorized and directed to enter into a Building Code administration agreement with the county for the enforcement of the Ohio Building Code within the limits of said village, whereby the County Building Department will exercise all enforcement authority, and accept and approve plans and specifications, and make inspections necessary within said village in accordance with the provisions of the Ohio Building Code. A copy of the Building Code administration agreement is attached hereto to Ord. 21-03 as Exhibit A.
   (E)   The terms of the Building Code administration agreement shall grant to the county full authority to do all things necessary to administer and enforce the Ohio Building Code within the limits of the village, and in consideration therefore, to allow the county to retain all permit, inspection, and other fees authorized by the state and the County Commission for such purposes.
   (F)   The Village Council further agrees to hold county harmless for all claims or causes of action of every kind and nature arising from the acts of the county, its agents, or employees, or representative in the administration and enforcement of the Ohio Building Code within the limits of the village except for the negligent or intentional acts of the county arising from the acts of its agents, employees or representatives.
