§ 73.99  PENALTY.
   In the event of a violation, the following penalties shall apply.
   (A)   For a first time violation, the person shall receive a written warning, and this chapter will be explained to them.
   (B)   Upon a second or subsequent violation, the person's skateboard, roller blades or similar devices shall be taken as evidence, and the Town Marshal and all other duly authorized law enforcement officers charged with enforcing the town's ordinances shall issue an appearance ticket and complaint, stating the date and time of violation, the name and address of the person violating this chapter, and ordering that person to appear on a certain date and time in the County Circuit Court in Fowler, Indiana, for the purpose of a trial thereon, if contested. Each violation of this chapter, after the first violation described in division (A) above, shall be punishable by a fine of $100, in addition to court costs. In the event that the person accused of violating this chapter wishes to admit the violation, he or she may pay the fine and court costs at the office of the Clerk of the county, County Courthouse, Fowler, Indiana.
   (C)   Each day of violation constitutes a separate and distinct violation of this chapter. The collection of penalties shall be conducted in any manner permitted by law.
