521.06 NAUSEOUS OR TOXIC CHEMICAL INSECT OR WEED KILLER.
   (a)   No owner, manager, agent or employee shall use, spray, distribute, blow or spread any nauseous or toxic chemical intended as an insect or weed killer in any manner or by any means, whether by thermal generators, spray, aerial spraying, or air pressure upon any land, property, premises or parcel of land not owned or controlled by such person, except for duly authorized Federal, State, County and Village agencies and their employees.
   Chemicals hereby declared to be nauseous and toxic and in violation of this section by their use are: Lindane, DDT, Amino Trizol and Sodium 2, 4 dichlorophonoxyethlene sulfate, or any of their by-products or related derivations. (Ord. 22-1999. Passed 8-11-99.)
   (b)   It is hereby declared to be prima-facie violation of this section whenever any of the above chemicals are permitted to be sprayed or become airborne by other means while the wind velocity exceeds three miles per hour or when such chemicals are permitted to be so spread or distributed within three feet of any line fence where cattle, sheep, swine or any other domestic animals are kept or grazed.

   (c)   Whoever violates this section is guilty of a minor misdemeanor.
