311.04 TRAFFIC CONTROL AT CONSTRUCTION SITES.
   (a)   Any contractor, construction company, individual, partnership, corporation or other entity involved in construction projects along any public street and/or highway within the Municipal limits, which interrupts or impedes the flow of traffic must provide for a Village police officer to be on duty during the hours of construction activity. Such police officer shall be provided to insure that traffic control is handled in a manner which will insure a steady and efficient flow of traffic. Whenever this section requires that a police officer be scheduled for traffic control, the construction company, individual or entity involved must commit to at least four hours per day of traffic control or the cost thereof. The officer scheduled shall be paid by the contractor or entity doing the construction at the rate of pay which is considered the customary rate in the northern part of Summit County for such services. Any scheduling of police officers pursuant to this section must be done through the office of the Chief of Police.

   (b)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
