(a) All Swimming Pools shall be kept free from any nuisance of any nature. The area shall be secured by a fence that complies with the requirements of Chapter 1386. No pool shall be filled with water until the fence has been constructed and approved by the Village Zoning Instructor or their designee.
(b) A Hot Tub or Spa shall be kept free from any nuisance of any nature. The area shall be secured by a fence that complies with the requirements of Chapter 1386 unless covered with a safety cover that complies with ASTM F 1346.
(c) Violation of this provision will result in the Village Zoning Inspector or their designee requiring the Swimming Pool or Hot Tub/Spa be immediately secured to protect the safety of the residents.
(d) Whoever violates this Section shall be subject to the penalties outlined in Section 1385.99 of this Chapter.
