(a) Each demolition of a vacant building requires that the owner pay the fee and hold in escrow with the Village a deposit in accordance with the Fee Schedule established by section 1101.05 of the Codified Ordinances of the Village of Boston Heights. If the amount to be set up in escrow cannot be paid in full, the Village will place a lien on the property for the amount specified. The Village will use these funds as described in section 1101.05, and/or to complete the plans submitted by the owner in the event that the owner does not comply with the deadlines as previously submitted in the owner's vacant building plan. Remaining escrowed funds will be released upon completion of the work or transfer of ownership, provided that all fees to date have been paid in full, and upon approval of the Zoning Inspector. New owners must sign a form accepting responsibility for completing the demolition.
(b) (1) The Zoning Inspector and/or the Planning Commission may require that a performance bond be made payable to the Village of Boston Heights for the issuance of a Zoning Permit in all Districts, in an amount up to one hundred and twenty-five percent (125%) of the demolition cost of the use, sufficient to preserve the interests of the Village with respect to such use. The bond must be issued by a recognized and approved bonding company licensed in the State of Ohio and acceptable to the Zoning Inspector. No project shall be released from such bond if there is a failure to comply with approved site plans.
(2) The Zoning Inspector and/or the Planning Commission may require that a maintenance bond be made payable to the Village of Boston Heights for the issuance of a Zoning Permit in all Districts, in the amount and duration to be determined by the Zoning Inspector. The bond must be issued by a recognized and approved bonding company licensed in the State of Ohio and acceptable to the Zoning Inspector. No project shall be released from such bond before the Zoning Inspector certifies compliance with the requirements and duration of such bond.
