(A) There is established a non-reverting fund to be utilized by the Boone County Highway Department (“BCHD”) to be designated as the “BCHD Non-Reverting Fund” (“Fund”). The county and BCHD may deposit in the fund such property or monies received from permit fees, donations, fines, reimbursement of insurance proceeds to damaged road infrastructure, reimbursements from the sale and/or disposal of surplus BCHD property, and miscellaneous receipts.
(B) The fund may receive and deposit such funds and they shall not revert to the county general fund, but shall be maintained in the fund from year to year.
(C) The funds captured may only be used for the purposes of operations of the BCHD. This includes payment for routine expenses such as (but not limited to) the purchase of equipment, payment of services, employee awards or incentives, and any expense or cost reasonably associated with the operations of BCHD.
(D) Claims may be made from this fund by the County Engineer or Operations Manager of the BCHD.
