§ 150.36 AVAILABLE FUNDS.
   (A)   Each year, prior to May 1, the county will determine whether or not it has available funds to apply dust control materials upon special request by citizens of the county for medical purposes. The Commissioners shall determine the amount of money available by May 1 of each calendar year.
   (B)   The amount of money available may be expended during that calendar year by applying dust control through the year, but not later than August 30 of each calendar year.
   (C)   Applications shall be taken on a first come first serve basis. When the funds have been expended no further applications will be accepted. Each application must contain a medical verification from a doctor duly licensed to practice law in the State of Indiana that the citizen requesting the application has a medical necessity to maintain low dust at or near his or her personal residence.
   (D)   Upon the application, which must be filed no later than May 1 of each calendar year hereafter, the county, at the county’s expense but to the limit of the funds available by May 1, shall undertake the application of dust control material upon the roads at or near the personal residence of the applicant.
   (E)   When the money has been expended no other applications will be received. The purpose of this section is to address medical issues. Any county resident may apply his or her own dust control materials so long as they comply with the terms and conditions of § 150.35.
