§ 30.06 AUCTION OF PROPERTY BY COUNTY SHERIFF.
   (A)   The Boone County Sheriff be, and he or she is, hereby authorized to dispose of, at sale or auction, any personal property seized and retained as evidence by the Boone County Sheriff’s Department, provided that the personal property and evidence to be auctioned or sold shall no longer be needed or required as evidence in any pending cases.
   (B)   The Boone County Sheriff shall determine the time and place of the auction or sale, the same to be conducted as often as the Sheriff deems it necessary to dispose of evidence no longer needed to be held and retained by the Sheriff’s Department for any purpose.
   (C)   It shall be the responsibility of the Boone County Sheriff to check with the Boone County Prosecuting Attorney’s Office, or the Prosecuting Attorney’s Office from any other judicial circuit in which the Boone County Sheriff’s Department has seized and holds evidence in pending cases, to make the determination that the personal property to be sold at sale or auction is no longer required or needed as evidence.
   (D)   The Boone County Sheriff shall assume sole and complete responsibility for the appropriate and legally authorize transfer of any handguns or other firearms as the result of the auction or sale and shall determine whatever policies or procedures may be necessary so to not violate any federal or state laws as a result of the auction or sale of these firearms.
   (E)   Any and all net proceeds as the result of the auction or sale shall be placed in Boone County’s general fund although nothing in this provision shall prohibit the Sheriff, in his or her discretion, to retain the services of an auctioneer or seller to facilitate liquidation of the property.
