§ 91.99 PENALTY.
   (A)    The County Inspector or his or her designated assistant may issue to the violator a citation which shall be written on a citation ticket, the form of which shall be approved by the Board of Commissioners.
   (B)   The owner or operator of an establishment who violates this chapter shall be guilty of a Class C infraction and may be fined up to $500, plus statutory court costs.
   (C)   Any person who commits a second or subsequent violation of this chapter in any one calendar year, shall be guilty of a Class B infraction, and may be fined up to $1,000, plus statutory court costs.
   (D)   Any person who receives a citation and pays the following fines (the minimum fine) within 15 days of the citation, shall not be cited into court for an infraction violation as set out above. The minimum fine for the first violation of this chapter within a one-year period shall be $100. The minimum fine for any second or subsequent violation shall be $200.
   (E)   The County Inspector or his or her designated assistant may issue a citation as a warning. If a warning is issued, the person or operator who receives the warning, shall correct the violation of this chapter within 15 days, or they may receive a citation, a minimum fine and/or be guilty of an infraction as set out above.
   (F)   Each day of any violation shall be deemed as a separate offense.
