§ 50.28 INSPECTION AND INVESTIGATION.
   (A)   Right of entry. The Board or its authorized representative, upon presentation of credentials, or by directive of the Board, shall have a right to enter upon, to or through premises, public or private, subject to this subchapter, or premises whereon violation of this subchapter is reasonably believed to be occurring or is reasonably believed to be about to occur, to investigate, take samples, copy all records related to waste, and inspect for compliance with the requirements imposed under this subchapter, or to determine whether such a violation or threatened violation exists, in accordance with the following purposes:
      (1)   For the purposes of determining whether any person is subject to the requirements of this subchapter, or whether any person subject to the requirements of this subchapter is in compliance with this subchapter;
      (2)   For the purpose of investigating conditions relating to waste management practices where the Board is in possession of information sufficient to form a reasonable belief that a violation of this subchapter is occurring or is about to occur; or
      (3)   For the purpose of determining whether there has been a violation of any of the provisions of this subchapter or any permit or order issued pursuant to this subchapter.
   (B)   Conduct of inspection and sampling.
      (1)   Each such investigation or inspection shall be completed with reasonable promptness.
      (2)   If the Board or its authorized representative obtains any sample prior to leaving the premises, he or she shall give to the owner, operator or agent in charge a receipt identifying the sample obtained and, if requested, a portion of the sample equal in volume or weight to the portion retained. If any analysis is made of the sample, a copy of the results of the analysis shall be furnished promptly to the owner, operator or agent in charge.
