§ 50.24 HAZARDOUS WASTE FACILITY STANDARDS.
   (A)   Federal, state or local approvals and permits for a hazardous waste landfill notwithstanding, within the boundaries of Boone County, Indiana, there shall be no disposal of hazardous waste within:
      (1)   Three hundred yards of any stream, creek or other surface water;
      (2)   Five hundred yards of any well which is used to provide water for human consumption;
      (3)   Five hundred yards of any church or school grounds; or
      (4)   Two hundred yards of any dwelling without the written consent of the occupant and owner of the dwelling.
   (B)   A hazardous waste landfill shall comply with all requirements hereof.
   (C)   (1)   An owner or operator of a hazardous waste facility shall furnish prior to treatment or disposal of a waste at the facility sufficient analyses for each such waste to enable the Board to determine:
         (a)   At what level any priority pollutant designated as toxic in § 307(a) of the Clean Water Act, as amended, 33 U.S.C. § 1317(a), is present in the hazardous waste;
         (b)   If the waste is reactive, corrosive or ignitable; or
         (c)   If the waste is infectious.
      (2)   The Board may order an owner or operator to provide additional analysis for this waste or to provide samples of the waste for analysis.
   (D)   Solid waste and hazardous waste shall not be disposed of in the same landfill cell without the prior written consent of the Board. In the event that the Board determines that hazardous waste must be segregated, the same shall be placed in a landfill cell which uses a liner to provide isolation of wastes from adjacent cells or wastes. The design of the landfill liner shall reflect a consideration of:
      (1)   The physical and chemical characteristics of the wastes in the landfill;
      (2)   The pressure head of leachate on the liner;
      (3)   Climatic conditions in the area;
      (4)   The permeability of the liner material, including compaction density and moisture content where earthen materials are present;
      (5)   The physical and chemical properties of the soil underlying the landfill that supports any emplaced liner; and
      (6)   The potential for damage to the liner system that could occur during installation of any emplaced liner.
   (E)   A hazardous waste facility shall not operate without a leachate and run-off control system which reduces to the extent technically feasible any air and water pollution. The design of such a leachate and run-off control system shall reflect a consideration of:
      (1)   The physical and chemical characteristics of the waste in the facility;
      (2)   Climatic conditions in the area;
      (3)   The volume of leachate or contaminated run-off that could be produced at the facility; and
      (4)   The available options for controlling any leachate or contaminated run-off that is collected at the facility.
