(A) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
ADMINISTRATIVE PERSONNEL. Any individual acting in the capacity of department head or as indicated by the Judge/Executive.
(B) The Judge/Executive shall inform the Fiscal Court of his/her intention to make an appointment of administrative personnel or members of county agencies, boards, commissions and special districts at a regular meeting. Fiscal Court approval will be requested for those nominations so required by state law. In those appointments requiring Fiscal Court approval, a majority of Fiscal Court members present at a meeting shall vote in favor of the nomination in order for the appointment to be approved.
(C) The Judge/Executive may dismiss any administrative personnel or member of county agencies, boards, commissions and special districts for failure to carry out his/her duties. The person shall be presented, in writing, with a list of reasons for dismissal. A hearing in closed session may be conducted at the next regularly scheduled meeting of Fiscal Court. At such hearing, the person to be dismissed shall have an opportunity to make a statement on his/her behalf; to be represented by any one of his/her choice; to call witnesses and present evidence; and to question any witness which testifies against him/her. The Judge/Executive shall issue a written opinion which shall contain the facts upon which his/her decision for dismissal is based. Failure of an individual to be reappointed shall not be construed as dismissal.
(D) Administrative personnel will be appointed for a period of one year, with the exception of the Road Supervisor who is appointed for two years in conformance with appropriate state law, commencing with the first month the Judge/Executive takes office. Members of county agencies, boards, commissions and special districts shall be appointed for a period as described by the agency, board, commission and special district by-laws. Failure to take action within 90 days of an individuals term ending date will result in automatic reappointment for a new term.
