§ 51.108 RIDGEVIEW/EVERGREEN DRIVE SANITARY SEWER FEE.
   (A)   The county hereby establishes the service limits of the Ridgeview/Evergreen Drive sanitary sewer service area as identified in Exhibit "A" which is attached to Ordinance 2020-04 and incorporated herein by reference. All dwelling units existing and of record as of July 1, 2019, and located within 500 feet of newly constructed sanitary sewer lines, are required to connect to said sewer lines pursuant to County Ordinance 610.3, enacted on August 28, 1990. Said dwelling units will cease to use any and all on-site treatment facilities. Any and all new dwelling units constructed within the sanitary sewer service area as defined in this section, on or after July 1, 2019, shall be required to connect to said sanitary sewer lines.
   (B)   (1)   The county hereby establishes a monthly sanitary sewer user fee for any and all users of the sanitary sewer system as defined herein in the amount of $35 per month per dwelling unit. This fee shall be in addition to all other fees and charges levied by the utility service provider operating said sanitary sewer system. All revenue derived from said sewer user fee shall be posted in the County's Fund 97 Capital Improvement Fund and used exclusively for the retirement of capital contribution from the county toward the project, representing the resident's portion of capital project funding requirements, in the amount of $750,000. The monthly sewer user fee shall be levied and collected until such time that the resident's capital project funding requirement is retired in full, but under no circumstances shall exceed 20 years, expiring no later than June 30, 2039, whichever occurs first.
      (2)   Monthly sanitary sewer user fees for any and all non-single-family residential uses shall be indexed to the system tap-in fees levied by SD1, in effect at the time of the application, as a percentage of the tap-in fee in effect for single-family residential connection to the sewer system. All other provisions and limitations for monthly sewer user fee revenue shall be consistent as stated herein.
      (3)   Any dwelling unit existing and of record on or before July 1, 2019, located with the sanitary sewer service area as defined herein and served by public sanitary sewer service, shall not be subject to the terms and provisions as stated herein including the monthly sanitary sewer user fee. Any property located outside of the sanitary sewer service area as defined herein, desiring to receive sanitary sewer service from the sewer system serving the Ridgeview/Evergreen Drive service area, may petition the county to amend the boundaries and service area to include said property located outside of the service area. Only properties contiguous with said service area may petition the county for inclusion within the service area boundary as defined herein.
   (C)   (1)   The county, upon completion, certification of construction and payment of all expenditures associated with the Ridgeview/Evergreen Drive Sanitary Sewer Project shall dedicate and transfer said sewer system to SD1 for ownership, operation, and maintenance in accordance with its rules and regulations. The county, via separate agreement, shall contract with SD1 for the collection and remittance of all sewer user fees.
      (2)   The County Administrator and/or County Treasurer/Director Finance shall report to the Fiscal Court at the end of each fiscal year all activity occurring with Fund 97 Capital Improvement Fund relating to the Ridgeview/Evergreen Drive Sanitary Sewer Project.
