(A) A violation of § 96.002 (obstructing sidewalk or street), § 96.005 (failure to warn of obstruction or dangerous condition, or removing or tampering with warning devices), or § 96.006 (depositing or maintaining injurious materials on street or sidewalk) of this chapter shall constitute an infraction and shall subject the offender or responsible person to a civil penalty of $100, and may also be subject to abatement as provided at division (B) below.
(B) Any circumstance or situation declared to be a public nuisance under the provisions of this chapter shall be subject to summary abatement by the town and/or notice and order to abate to the responsible person(s) pursuant to the provisions of §§ 80.07 through 80.14 and § 80.99 of this code, just as if the nuisance constituted a violation of Chapter 80; and the provisions of §§ 80.07 through 80.14 and § 80.99 are incorporated herein as if fully set forth herein.
