§ 152.22 NOTIFICATION.
   (A)   All landlords who lease dwelling units located within a flood zone shall disclose to all prospective tenants, by means of a written notice in at least 16-point type that is separate from other lease or application materials and provided before the lease is signed, a notice that contains all of the following:
      (1)   The specific flood zone in which the dwelling unit is located;
      (2)   That the specific flood zone may not accurately reflect the frequency of flooding;
      (3)   That the landlord will not accept responsibility for damage to or destruction of the tenant's property by flooding (unless the landlord accepts responsibility);
      (4)   That renter's flood insurance is available through the National Flood Insurance Program, and that the tenant may visit www.floodsmart.gov for more information on the National Flood Insurance Program;
      (5)   To the extent the landlord has actual knowledge, the years in which flooding of the dwelling unit has occurred; and
      (6)   This notice shall be signed and dated by the tenant.
   (B)   Sample notice.
 
   Notice of Possible Flooding
   The dwelling unit at (insert address) is located within the (insert flood zone) flood zone. Consequently, there is the possibility in any given year that this dwelling unit may be flooded.
   Previously, flood zones were known as (1) the floodway, (2) the 100-year flood plain or (3) the 500-year flood plain. FEMA now uses the following terminology:
      (1)   Floodway = AE Floodway
      (2)   100-Year Floodplain = AE Zone
      (3)   500-Year Floodplain = Zone X
   It is important for tenants to note that the category of flood zone may not accurately reflect actual frequency of flooding.
   Landlord is aware that the dwelling unit at (insert address) has been flooded (insert number of times) in the past (number of years).
   The landlord (choose one) does or does not accept responsibility for damage to or destruction of the tenant's property resulting from flooding.
   The tenant is hereby notified that renter's flood insurance policies are available through your insurance agent.
   The renter is encouraged to visit www.floodsmart.gov for more information on the National Flood Insurance Program.
