Any person violating any provision of this chapter for the first time, upon conviction, shall be guilty of an infraction with a penalty of one hundred dollars ($100.00). A second violation shall be an infraction with a penalty of three hundred dollars ($300.00). A third or subsequent violation of this chapter shall be a misdemeanor, and upon conviction, subject to penalty as provided in Idaho Code and 1-4-1 of this code.
