§ 93.11 CARE OF TREES ON PRIVATE PROPERTY.
   (A)   The Tree Commission shall, by written notice to the owner of private property, cause said owner, or if the owner fails to do so within a reasonable period of time, cause the village to prune any branch or branches of any tree so that the branches do not obstruct the light from any street lamp, obstruct the view of any traffic control device, street sign or directional marker, obstruct any intersection of streets or public ways by not having a clear space of at least eight feet above the surface of any street or public way.
   (B)   The Tree Commission shall, by written notice to the owner of private property, cause said owner, or if the owner fails to do so within a reasonable period of time, cause the village to remove any tree that is dead or diseased on private property when such dead or diseased tree constitutes a danger to public safety, or is infested with disease or insects that present a danger and threat to other trees within the village.
   (C)   Should removal or care of a tree that is the responsibility of a property owner be undertaken by the village due to the owner’s failure to remedy the situation within a reasonable time, then any and all expenses incurred by the village shall be assessed to the property owner and shall be placed upon the real property tax duplicate according to law.
   (D)   Notice to the owners shall be as set forth in this chapter.
