§ 93.10 CARE OF PUBLIC TREES.
   (A)   The Tree Commission shall be the conservator, and agent for the village for the care of any public tree as defined in this chapter. The Tree Commission shall, subject to this chapter, have the right to plant, maintain and remove trees, plants and shrubs within the right-of-way of any street, alley or public way of the village including, but not limited to, any other public grounds.
   (B)   The Tree Commission shall have the right to cause to be removed all or part of any tree that by reason of its condition or location is unsafe to persons or property, interferes with any utility or public improvement, or which is affected by any injurious fungus, insect or other pest.
   (C)   In executing its duty as conservator of the public trees of the village and exercising the powers granted in this section, the Tree Commission shall be guided by two overriding principles:
      (1)   Ensure public safety at all times; and
      (2)   The symmetry and beauty of public grounds and ways.
