(A) Findings.
(1) The city has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and that protect the public health, safety and welfare of its citizens.
(2) This subchapter is adopted pursuant to the provisions of 220 ILCS 5/21-100 et seq., the Illinois Cable and Video Competition Law of 2007, Public Act 95-0009 (the “Act”).
(3) This subchapter is intended to establish the service provider fee and the PEG access support fee the Act authorizes municipalities to impose on a holder under 220 ILCS 5/21-801.
(B) Adoption. All prior city cable televisions ordinances, including Ord. 2450, 01-360, 2001-375, 2001-376 and 2001-377, are hereby amended by the adoption of this subchapter, and where inconsistent with this subchapter, this subchapter shall supersede said prior ordinance or ordinances.
