§ 51.038 DISPOSITION OF DEPOSIT.
   (A)   The deposit provided in § 51.037 shall be held by the City Clerk for a period of 60 days after the restoration. If after 60 days, and after inspection by the Department of Municipal Services, the street or alley is in a condition acceptable to the city, the deposit shall be returned to the depositor.
   (B)   (1)   If the Department of Municipal Services deems that further work is necessary to restore the street or alley, and upon refusal or failure of the depositor to make the required corrections, the city may do the necessary work with the costs thereof being deducted from the deposit.
      (2)   The balance of the deposit, if any, shall be returned to the depositor, if the costs of proper restoration exceed the deposit, then the depositor shall pay to the city the amount of the excess.
