309.11 APPEAL PROCEDURE.
   (a)   Any applicant shall have the right to appeal the denial of a parade or public assembly permit to the City Council.
   (b)   Any appeal or determinations made by the City Manager or his designee shall be appealed to the City Council within five (5) days of the determination made by the City Manager or his designee. The City Council by majority vote shall sustain, amend, or reverse the determination of the City Manager or his designee at the next scheduled Council Meeting after the filing of the appeal. If the City Council fails to sustain, amend, or reverse the City Manager’s or his designee’s determination at the next scheduled Council Meeting, the permit application shall be deemed granted. An untimely appeal shall not be considered by the City Council and its determination shall be deemed final.
   (c)   A parade applicant whose appeal application is denied or modified by the City Council shall have the right to appeal as provided under Ohio R.C. Chapter 2506 or otherwise under Ohio or federal law. The court obtaining jurisdiction of such appeal shall render a decision within thirty (30) days from the date of the filing of the appeal.
