1711.01 DEFINITIONS.
   (a)   "Accessory structure" means a subordinate building, the use of which is incidental to and customary in connection with the principal building and use, which is located on the same lot with such principal building and use, and which shall be complimentary, including architecturally, to the principal building and use.
   (b)   "Basement" means a story having part but not more than one-half of its height below grade. A basement is counted as a story for the purpose of height regulation if subdivided and used for business or dwelling purposes other than by a janitor employed on the premises.
   (c)   "Building Code" means the Hamilton County Building Code as adopted by the City of Blue Ash, Ohio.
   (d)   "Cellar" means a story having more than one-half (1/2) of its height below grade. A cellar is not included in computing the number of stories for the purpose of height measurements.
   (e)   "City Manager" means the City Manager of Blue Ash, Ohio, or his designee.
   (f)   "Dwelling" means a building or portion thereof designated or used exclusively for residential occupancy, but not including trailers, mobile homes, manufactured homes (and similar units), hotels, motels, boarding houses, fraternities, sororities or tourist homes.
   (g)   "Dwelling, multiple" means a building, or portion thereof, designed for or occupied by three (3) or more families.
   (h)   "Dwelling unit" means a room or suite of rooms used as a single-family dwelling including bath and culinary accommodations.
   (i)   "Exterior property areas" means all areas of a premises not within a building.
   (j)   "Extermination" means the control and elimination of insects, rodents or other pests.
   (k)   "Garbage" means the animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food.
   (l)   "Habitable room" means a room or enclosed floor space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathrooms, water closet compartments, laundries, pantries, foyers or communicating corridors, closets and storage spaces.
   (m)   "Infestation" means the presence, within or around a dwelling, of any insects, rodents or other pests.
   (n)   "Occupant" means any person or persons who are over one year of age, living, sleeping, cooking or eating in, or having actual possession of, a dwelling unit or rooming unit.
   (o)   "Operator" means any person who has charge, care or control of a building, or part thereof, in which dwelling units or rooming units are let.
   (p)   "Owner" means any person who, alone or jointly or severally with others:
      (1)   Shall have legal title to any dwelling or dwelling unit, with or without accompanying actual possession thereof; or
      (2)   Shall have charge, care or control of any dwelling or dwelling unit, as owner or agent of the owner, or as executor, executrix, administrator, administratrix, trustee or guardian of the estate of the owner.
   (q)   "Person" includes any individual, firm, corporation, association or partnership.
   (r)   "Plumbing" includes all of the following supplied facilities and equipment: gas pipes, gas-burning equipment, water pipes, garbage disposal units, waste pipes, water closets, sinks, permanently installed dishwashers, lavatories, bathtubs, shower baths, permanently installed clothes washing machines, catch basins, drain vents and any other similar supplied fixtures, together with all connections to water, sewer or gas lines.
   (s)   "Premises" means land together with any buildings or structures occupying it.
   (t)   "Rubbish" means combustible and noncombustible waste materials, except garbage; and the term shall include the residue from the burning of wood, coal, coke and other combustible material, paper, rags, cartons, boxes, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery and dust.
   (u)   "Supplied" means paid for, furnished or provided by or under control of the owner or operator.
   (v)   Meaning of Certain Words. Words used in the present tense include the future. The singular number includes the plural and the plural the singular. "Building" includes "structure". The words "dwelling", "dwelling unit", "rooming house", "rooming unit" and "premises" shall be construed as though they are followed by the words "or any part thereof".
