1311.05 PROTECTIVE BARRIER REQUIREMENTS.
   (a)   All outdoor swimming pools, including aboveground and belowground level pools, whether erected on a permanent or temporary basis, shall be completely enclosed by a fence no part of which shall be closer than four (4) feet to the water.
   (b)   All fence openings or points of entry into the pool area enclosure shall be equipped with gates.
   (c)   The fence and gates shall not be less than forty-two (42) inches in height measured from the ground level and shall be constructed of a minimum number nine (9) gauge woven wire mesh corrosion-resistant material, or similar material, having no openings, holes or gaps larger than two and one-half (2-1/2) inches in any dimension, provided however:
      (1)   That such fence and gates not less than three (3) feet in height measured from the ground level shall suffice with respect to any such fence or gates already constructed on July 1, 1972 until replacement or major repair thereof is effected and provided the same are registered with the City Manager or his authorized representative on or before October 1, 1972; and
      (2)   That such fence and gates having no openings, holes or gaps larger than four (4) inches shall suffice with respect to any such fence or gates already constructed on September 27, 1973 until replacement or major repair thereof is effected.
   (d)   A dwelling house or accessory building may be used as part of such enclosure.
   (e)   All gates or doors opening through such enclosure shall be equipped with a self-closing and self-latching device placed at the top of the gate or door for keeping the gate or door securely closed at all times when not in actual use; except that the door of any dwelling house which forms a part of the enclosure need not be so equipped.
   (f)   Fence posts shall be decay or corrosion resistant and shall be set in concrete bases.
