707.06 APPEAL OF DENIAL.
   If an application has been denied as stated herein, the applicant may appeal such denial within ten days after written notice of such denial to the City Manager. The City Manager, or his or her designee, may then hold a hearing at which the applicant may present appropriate evidence to substantiate their fitness and moral character, or to refute the findings of the Assistant City Manager or Chief of Police to allow the City Manager to consider whether or not to overrule the disapproval of the application or to uphold the decision of the Chief of Police. For good cause shown, the City Manager may overrule the Chief of Police and grant the applicant’s permit. If the City Manager fails to render a decision on the denial of the application within ten (10) business days from the date the applicant files the appeal, then the decision of the Assistant City Manager or Chief of Police shall be deemed to be overruled and the permit granted.
