(a) No person shall plant or remove trees or shrubs in public places, without first filing an application and obtaining a permit from the City Forester.
(b) The following provisions apply to the issuance of permits where required for planting in public places.
(1) Application data. The application required herein shall state the number of trees or plants to be planted or set out; the location and specific name of each tree or plant.
(2) Standards for issuance. A permit shall be issued if it is found that the proposed plantings will not conflict with planned public facilities, or become a public hazard. All such applications will be reviewed by the City Engineer, the City Traffic Engineer and the Division of City Planning.
(3) Maintenance of trees in public boulevards. The boulevard (area between the property line and curb or street) is public right-of-way. The maintenance and care of the trees in the boulevard area shall be the responsibility of the abutting property owner.
