(A) In order to obtain a permit to drill and/or operate any of the facilities listed in § 52.01 of this chapter, the owner of property on which the proposed facility is to be located, must make application on the proper form provided by the city.
(B) Such application must be presented to the Utility Superintendent and, after reviewing the application of any person desiring to drill or operate any of the above-described facilities, then the Utility Superintendent may approve or deny said permit.
(C) The applicant may appeal the decision of the Utility Superintendent to the City Council at the next regularly scheduled City Council meeting.
