10-18-3: CONDOMINIUMS, TOWNHOUSES TO BE DEVELOPED AS PLANNED UNIT DEVELOPMENTS:
Where, in the opinion of the Planning Commission or City Council, the unique features of a condominium project (i.e., ownership, financing, topography, types of land uses, etc.) require more flexibility in design solutions in order to protect the public interest.  The proposed condominium project shall comply with the provisions of this ordinance and contrary provisions of other ordinances adopted by the City may be waived by the City Council. 
All condominiums, townhouses and similar developments will be based on private property ownership following the footprint of each individual unit and all other property will be commonly owned or dedicated to a specific use, or have covenants that safeguard the unit's property value, maintain quality living conditions, and address property maintenance and use.
