12-4-5: THIRD PARTY RIGHTS:

Except as otherwise expressly provided in a development agreement, the development agreement shall create no rights enforceable by any party that is not a party to the development agreement. Purchasers of lots in approved subdivisions are not deemed to be third party beneficiaries of development agreements. (2003 Code § 12-05-05)
