The purpose of a development agreement is to specify certain land use and development regulations that will apply to the relevant property, to establish conditions of approval, to establish terms of mitigation, to describe the scope of construction improvements, and to foster an understanding between the city and the developer. It shall be a requirement of compliance with this title that a development agreement and construction improvement agreement be entered into and approved by the city prior to initiating physical construction of subdivision improvements or recordation of a subdivision plat.
