A. Submittal: Applications for subdivisions shall be submitted and accepted at least forty five (45) days before the date of the public hearing at which it is to be reviewed. Minor subdivisions may be submitted to the city engineer at any time. No application for a subdivision shall be accepted until a preliminary site plan review has been completed and a written site plan review report has been issued by the city engineer. The city engineer may waive the preliminary site plan review for a minor subdivision.
B. Direction Of City Engineer: The developer shall have the option of seeking the direction of the city engineer as to which approvals are required and the appropriate review process, or of filing an application the developer believes to be appropriate. The city engineer's determination shall be presumed to be correct. (2003 Code § 12-03-03)
