12-1-10: INTERPRETATION, CONFLICT AND SEPARABILITY:
   A.   In their interpretation and application, the provisions of this title shall be held to be the minimum requirements. More stringent provisions may be required if it is demonstrated that such standards are necessary to protect the public health, safety and welfare.
   B.   These regulations are not intended to interfere with, abrogate, or annul any other ordinance, rule, regulation, statute, or other provision of law except as provided in these regulations. Where any provision of these regulations imposes restrictions different from those imposed by any other provision of these regulations or any other ordinance, rule, regulation, or other provision of law, the provision that is more restrictive or imposes the standards most likely to protect the public health, safety and general welfare shall control.
   C.   These regulations are not intended to abrogate any easement, private covenant or any other private agreement or restriction; provided, that where the provisions of these regulations are more restrictive or impose higher standards or regulation, the requirements of these regulations shall govern irrespective of private contractual provision.
   D.   The provisions of this title are severable. If any section, sentence, clause or phrase of this title is adjudged by a court of competent jurisdiction to be invalid, the decision shall not affect the remaining portions of this title. The remainder shall be interpreted to further the purposes of this title.
   E.   The provisions of this title serve to supersede prior ordinances regulating subdivision of land in the city. (2003 Code § 12-01-09)
