7-2-3: DRIVING RULES AND REGULATIONS:
   A.   State Laws Adopted; Citation:
      1.   Adoption: There hereby is adopted the motor vehicle laws of the state, that being particularly Idaho Code title 49, as presently in effect or as may hereafter be amended, marked and identified as the Idaho motor vehicle laws, and published annually by the authority of the state department of transportation, for the regulation of motor vehicles and motor vehicle traffic within the municipal boundaries of the city, and said state motor vehicle laws, and any subsequent amendments enacted into law by the state legislature, contained in said document, or its subsequent editions.
      2.   Form Of Citations: Law enforcement officers may issue citations on the standard uniform state citation form for violations of state vehicle laws within the city limits. Alternatively, law enforcement officers may issue citations on a city citation form for violations that, pursuant to any particular city code provision, may be classified as a city code violation. Such city code violation citations shall be processed pursuant to section 1-4-6 of this code. (2003 Code § 10-10-01)
   B.   Operating Vehicles On Bike Lanes And Paths: No person shall drive a motorized vehicle upon any officially marked bike lane, bike path, footpath or other separate right of way specifically set aside for use by pedestrians or nonmotorized vehicles, except at an intersection or when entering or leaving a roadway at a driveway, private road or alley. Prior to crossing a nonmotorized right of way, the motorist shall yield the right of way to any pedestrian or nonmotorized vehicle operating thereon. This subsection shall not apply to authorized emergency vehicles meeting the conditions specified in Idaho Code section 49-623, or authorized maintenance and construction vehicles while actually engaged in work upon a roadway or nonmotorized right of way. Violation of this section shall constitute an infraction, subject to penalty as provided in title 1, chapter 4 of this code. (2003 Code § 10-10-05; amd. 2012 Code)
   C.   Cutting Through Parking Lots: No person shall drive a motorized vehicle through or over a parking lot, driveway or entrance to a residence, business or building to avoid driving through an intersection. Violation of this section shall constitute an infraction, subject to penalty as provided in title 1, chapter 4 of this code. (2003 Code § 10-10-06; amd. 2012 Code)
   D.   Jake Brakes Usage Prohibited:
      1.   Purpose: The purpose of this subsection is to make it unlawful for vehicles equipped with compression release type braking systems, commonly known as "jake brakes", to use such braking systems or devices upon any public streets, roads or highways within the limits of the city for the peace, health and comfort of the citizens of the city and the public.
      2.   Definition: For the purpose of this section, "compression release type braking systems" shall mean any devices equipped on vehicles, including, but not limited to, tractors, semitrucks, motor carriers and buses that utilized engine compression release or engine retarders as a means of slowing or braking the speed of the vehicle in lieu of applying the clutch or foot brakes.       3.   Prohibitive Acts: Every driver of a vehicle who shall cause his or her vehicle to brake or allow by any method that increases the noise emission levels of the engine such as engine compression release or engine retarder in lieu of applying the clutch or foot brakes upon any public streets, roads or highways within the limits of the city, shall be guilty of an infraction, subject to penalty as provided in title 1, chapter 4 of this code.
