A. Basic Rule: No person shall operate a vehicle within the limits of the city, at a speed greater than is reasonable and prudent under the conditions. (2003 Code § 10-05-01)
B. General Speed Limit: Subject to the provisions of subsection A of this section, no person shall drive or operate any vehicle in excess of the speed set forth below:
1. Any speed established pursuant to subsection C of this section.
2. Ten (10) miles per hour in any alley.
3. Ten (10) miles per hour in any public park.
4. Twenty (20) miles per hour when passing any school building or when crossing any marked school zone, such zone to extend one hundred fifty feet (150'), unless otherwise posted, in either direction from any marked school crossing when appropriate signs giving notice thereof are erected, and any of the following exist:
a. A school speed limit sign with a time period specified. In such case, the twenty (20) miles per hour limit shall apply only during the specified time period.
5. Twenty five (25) miles per hour upon all other streets, unless otherwise specified by appropriate signage. (2003 Code § 10-05-02; amd. 2012 Code)
C. Establishment Of Speed Limits: Whenever the city council determines, upon the basis of an investigation, that any prima facie speed set forth in subsection B of this section is greater or less than is reasonable or safe under the conditions found to exist at any location within the city, the city council may determine and declare by resolution a reasonable and safe prima facie speed limit, which, when proper signs giving notice thereof have been erected, shall be the speed limit for such street or portion thereof. 1. Chief Of Police Authorized To Set Temporary Speed Limits: At such times that a special event is being held within the city, which creates high volumes of pedestrian and/or vehicle traffic, the chief of police is authorized to temporarily reduce speed limits near the special event in his discretion for the safety of all participants, visitors and attendees. Any such reduction shall not exceed ten (10) days. When the chief of police determines that a temporary speed limit reduction is necessary, he or she shall notify the city council and mayor as soon as reasonably possible by telephone, electronic mail, in person, or other similar means of communication. During the period of time so described, the speed limit set by the chief of police shall be the speed limit for such streets or portions thereof so long as proper signs giving notice have been erected. Any reduction in a speed limit in excess of ten (10) days shall have prior city council approval by resolution per this subsection C. (Ord. 2151, 1-3-2017)
D. Minimum Speed Regulations: No person shall drive a vehicle at such a slow speed as to impede or block the safe and efficient movement of vehicular traffic. (2003 Code § 10-05-04)
E. Citation; Penalty: Violations of the provisions of this chapter may be charged as an infraction on a uniform state citation form and processed through the county court system, in which case the fine shall be as designated under Idaho Code title 49. Alternatively, violations of the provisions of this chapter may be charged on a city citation form as a city code violation, which shall carry a penalty of fifty dollars ($50.00) and shall be processed pursuant to section 1-4-6 of this code. Speeding violations of twenty (20) miles per hour over the speed limit and charged as a city code violation, shall carry an enhanced penalty of one hundred dollars ($100.00). (2003 Code § 10-05-05)
